Masterweb Freeware End User License Agreement PLEASE READ THE FOLLOWING END-USER LICENSE AGREEMENT CAREFULLY. This End User License agreement is between Cyber Industries, Inc. (the "Owner" of the software program titled Masterweb Builder Wizard (the "Software") of various versions and You the User of the software. RIGHTS: a. To use the Software an unlimited number of times provided that these parties accept the terms of this Agreement. b. To distribute the Software to third parties, provided that these parties accept the terms of this Agreement. c. You may permanently transfer all of your rights provided by this end-user license provided you do not receive any payment or other compensation for transferring the Software and the recipient agrees to the terms of this end-user license. IT IS STRICTLY PROHIBITED TO: a. Modify the Software in whole or in part. b. Modify the copyright notices on all copies of the Software. c. Rental. You may not rent or lease or lend the Software. d. Reverse engineer, decompile, or disassemble the software product. SHOULD YOU FAIL TO COMPLY WITH ANY OF THE CLAUSES ABOVE, YOUR USER RIGHTS ARE AUTOMATICALLY TERMINATED. THIS TERMINATION IS IN ADDITION TO THE LEGAL, CIVIL OR OTHER REMEDIES THAT THE OWNER MAY SEEK. LIMITED WARRANTY: DISCLAIMER FOR INDIRECT DAMAGES. This program is provided and licensed "as is", without any warranty of any type, either express or implied, including, but not limited to, implied warranties of merchantability or fitness for a particular purpose. In no event shall the Owner or any other third parties involved in the creation, production, or delivery of the program be liable for any type of damage, in any circumstance (including, but not limited to, the direct or indirect damages caused by loss of business profits, business interruption, loss of business information, or any other pecuniary loss), arising out of the use of or the inability to use the software product, even if the Owner has been advised of the possibility of such damages. The user is entirely responsible for the results or performance of this software product. The Owner may terminate this license at all times by posting a notice of such intention on its web site at www.Masterweb.ca. The user may terminate the End-User license by either destroying or erasing all copies of the Software product. This limited warranty is governed by and interpreted according to Canadian law in the Province of British Columbia. PROPERTY: "Masterweb Builder Wizard" is a trademark of the Owner and is protected by the Canadian laws on trademarks and intellectual property. Any use of the software product name is strictly prohibited without the written permission of the Owner. The Software product, including its code, documentation, appearance, structure and design, is an exclusive product of the Owner., who permanently preserves all property rights to the Software product or its copies, modifications, or merged parts.
